At its April 16, 2009 meeting the Superior Court Rules Committee tabled proposals to amend Rules 3.8 and 4.2 because the Criminal Practice Commission had not yet made its recommendations regarding the proposals.
Over at the Criminal Practice Commission, a subcommittee (The Committee Regarding Proposed Revisions to the Rules of Professional Conduct) has been created.
If I can track down the proposals I will post them.
Note: The ABA recently adopted a new Model Rule 3.8, which focuses on the duty of prosecutors to disclose new evidence. For an article from the ABA Journal about the new 3.8 and its journey through the ABA legislative process click here.
