The Financial Crisis: The imminent return of an expensive question – “Where were the lawyers?”

During the S&L crisis law firms representing some financial institutions ended up as defendants facing allegations that they assisted their clients in violating the law.  An article at, OCC Lawyers Challenge Proposed Dismissal of Charges Against Miami Attorney, may be an early indication that once again lawyers will be at risk of facing charges that they assisted their clients in breaking the law.  Managing partners, practice group leaders, ethics counsel, p.r. departments and malpractice carriers may want to take notice.
